OFCCP released an updated complaint form which allows any employee or applicant of a federal contractor to file a complaint of discrimination or retaliation based on the following:

  • Race
  • Color
  • Religion
  • Sex
  • Sexual Orientation
  • Gender Identity
  • National Origin
  • Disability
  • Status as a Protected Veteran
  • Under certain circumstances an applicant or employee may also be protected for asking about, discussing, or sharing information about pay

The new form, CC-4, seeks identifying information about the complainant, a description of the events that form the basis of the complaint, and whether the complainant has retained counsel. The process of filing a complaint now includes the ability to file a complaint online (including via their cell phone or any other handheld device) and an automatic submission to an OFCCP regional office.

Complaint investigations may trigger a full compliance review by OFCCP.  They can also serve as cause to reopen recently closed audits.  So far in FY 2017, OFCCP has concluded 93 complaint investigations.  These included complaints of discrimination based on Disability, Veteran, Race, Gender, Other, National Origin, Religion, and Color.
