The OFCCP is revising the regulations implementing Executive Order (EO) 11246, as amended, in accordance with EO 13672 which was signed into law by President Obama July 21, 2014.
What has changed?
EO 11246, which previously only prohibited discrimination by Federal contractors and subcontractors on the basis of race, color, religion, sex, and national origin, and required them to take affirmative measures to prevent discrimination on the basis of those categories from occurring.
EO 13672, revises the above language by substituting the phrase “sex, sexual orientation, gender identity, or national origin” for “sex or national origin”.
How does this affect me?
You are required to substitute the phrase, “sex, sexual orientation, gender identity, or national origin for “sex or national origin” in current policy statements/AAPs, etc.
The complete new phrasing should include the following: (Company Name) will not discriminate against any employee or applicant for employment because of race, color, religion, sex, sexual orientation, gender identity, national origin, age, marital status, genetic information, disability or because he or she is a protected veteran.
When does it go into effect?
Contractors may comply at any time, though it is only required for new contracts after April 8, 2015.
